NEW DELHI: A bunch of pleas against the Delhi government's legislation empowering the corporations to levy property tax on the basis of unit area was dismissed on Thursday by the Delhi high court. A division bench dismissed the plea, saying the Assembly "had the power and competence to legislate with regard to taxes on lands and buildings".
The pleas, by a few individuals, had pleaded with the court to declare the Delhi Municipal Corporation (Amendment) Act, 2003, and the Delhi Municipal Corporation (Property Tax) Bye-laws, 2004, as unconstitutional, on the alleged ground that the government has no power to enact them.
The court rejected the plea that the penalties prescribed were beyond the legislative competence of the Delhi government. It also rejected the argument that the unit area method is not a recognized system of valuation and a flat rate of taxation under the method is arbitrary and discriminatory.
